Welcome to the Pickett v. Town & Country Bank Settlement Website
If you were assessed a Challenged Fee by Town & Country Bank, you could get a payment and/or other benefits from a class action settlement.
- The settlement relates to certain fees* (defined in the first footnote below) that Town & Country Bank** (“Defendant”) charged between February 1, 2013 through February 1, 2023. If you were charged such a fee, you are a member of the Settlement Class.
- Class Members who do nothing will automatically receive a check or account credit. These payments and credits will be from the Net Settlement Fund based on a percentage of the amount of applicable fees paid. The amount of these payments will be determined by an independent settlement administrator and not by Defendant.
- Your legal rights are affected, so please read the notice carefully.
* "Challenged Fees" means $31.29 average overdraft fees on one-time non-PIN based debit card transaction that authorized into a positive available balance but that later posted into a negative available balance ("APSN Fees").
** Town and Country Bank was acquired by, and merged in, Heartland Bank & Trust Company.
YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT
Exclusion Deadline
Get no benefits from the settlement. Keep the right to bring a separate lawsuit about the same issue at your own expense.
Objection Deadline
Write to the Court about why you don’t like the settlement. If the settlement is approved you will still automatically receive a check or account credit and give up the right to bring a separate lawsuit about the same issue.
Final Approval Hearing
The Court will hold a hearing on March 7, 2025 at 10:00 A.M. at the Sangamon County Courthouse, 200 S. 9th Street, Springfield, IL 62701 to decide whether to approve the settlement.
